The Rotary Club of Norfolk Sunrise Fund

 

Governance:

The Rotary Club of Norfolk Sunrise Fund (“Foundation”) is a Public Foundation as a Registered Charity under the Income Tax Act (Canada). The Rotary Club of Norfolk Sunrise Fund was granted its Letters of Patent on December 8, 1997 registered in the Province of Ontario as a not-for-profit organization with the following objective:

  • To establish a fund by fundraising, and to apply all of the fund or part thereof and the income there from to charitable organizationsIncome Tax Act (Canada) that are also registered charities pursuant to the Income Tax Act (Canada).

The Rotary Club of Norfolk Sunrise Fund also operates with the following provisions :

  • The Corporation shall be carried on without the purpose of gain for its members, and any profits or other accretions to the Corporation shall be used in promoting its objects.
  • The Corporation, as a fund raising Corporation for registered charities pursuant to the Income Tax Act (Canada), shall be subject to the Charities Accounting Act and the Charitable Gifts Act.
  • The Directors shall serve as such without remuneration, and no Director shall directly or indirectly receive any profit from his position as such; provided that Directors may be paid reasonable expenses incurred by them in the performance of their duties.
  • To qualify and remain as a Director, each Director shall be a member of Rotary
  • Upon dissolution of the Corporation and after the payment of all debts and liabilities, its remaining property shall be distributed or disposed of to charitable organizations which carry on their work solely in Canada.
  • The borrowing power of the corporation pursuant to any by-law passed and confirmed in accordance with section 59 of the Corporations Act shall be limited to borrowing money for current operating expenses, provided that the borrowing power of the corporation shall not be so limited if it borrows on the security of real or personal property

 

If it is made to appear to the satisfaction of the Minster, upon report of the Public Guardian and Trustee, that the corporation has failed to comply with any of the provisions of the Charities Accounting Act or the Charitable Gifts Act, the Minister may authorize an inquiry for the purpose of determining whether or not there is sufficient cause for the Lieutenant governor to make an order under subsection 317(1) of the Corporations Act to cancel the letters patent of the corporation and declare them to be dissolved.

Upon the dissolution of the corporation and after payment of all debts and liabilities, its remaining property shall be distributed or disposed of to charitable organizations which carry on their work solely in Ontario.

After receiving the Letters of Patent, The Rotary Club of Norfolk Sunrise Fund applied to become a Registered Charity.  The Rotary Club of Norfolk Sunrise Fund was designated as a Public Foundation on July 1, 1998 with the Federal government under the Business Number 86892 2691 RR0001 to operate within the above objects and provisions under paragraph 149(1)(f) of the Income Tax Act (Canada).

The Rotary Club of Norfolk Sunrise Fund as Registered Charity under the Income Tax Act (Canada) is allowed to issue tax receipts for donations received.  As a Public Foundation, the organization may only support other charitable organizations that are Registered Charities within Canada.  The money disbursed by The Rotary Club of Norfolk Sunrise Fund goes to a range of both local and international communities for service projects through supporting other charitable organizations that are registered under the Income Tax Act (Canada).

The Rotary Club of Norfolk Sunrise Fund is administered by a Board of Directors comprised of members of The Rotary Club of Norfolk Sunrise.

Contributions:

The Rotary Club of Norfolk Sunrise Fund receives contributions from various sources from the public.  Major contributors include The Rotary Club of Norfolk Sunrise, corporations and private individuals.

Tax receipts are issued for all contributions received by The Rotary Club of Norfolk Sunrise Fund pursuant to the Income Tax Act (Canada).

 

Disbursements:

As a Public Foundation, the organization may only support other charitable organizations that are Registered Charities within Canada.
